4. Accessing our site

4.1

You do not need to register with us or create an account to browse our Site.

4.2

Our Site is intended for business to business and professional use and is not suitable for use by individuals in their personal capacities.

4.3

The materials and content comprising the Site belong to us or our third party licensors, and we hereby give you permission to access, view and use these materials and content for the sole purpose of using the Site in accordance with these Terms of Use.

4.4

Your right to use the Site is personal to you and you are not allowed to give this right to any other person. Your right to use the Site does not stop us from giving other people the right to use the Site.

5.1

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

5.2

You must not establish a link from any website that is not owned by you.

5.3

Our Site must not be framed on any other Site, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice.

6. Rules of accettable use

6.1

In addition to the other requirements within these Terms of Use, this section describes specific rules that apply to your use of the Site (the “Rules of Acceptable Use”).

(c) take any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure;
(d) use the Site for commercial purposes, or accept any payment or commission in relation to your use of the Site;
(e) modify, interfere, intercept, disrupt or hack the Site;
(f) introduce viruses, Trojans, worms, logic bombs, invalid data or other material which could harm the Site;
(g) collect any data from the Site other than in accordance with these Terms of Use (including by any automated or non-automated “scraping”); or
(h) use any automated system, including without limitation “robots”, “spiders” or “offline readers” to access the Site in a manner that send more request messages to the Site than a human can reasonably produce in the same period of time (except that we grant the operators of public search engines revocable permission to use spiders to copy publicly available materials from the Site for the sole purpose of, and solely to the extent necessary for, creating publicly available searchable indices of the materials but not caches or archives of such materials).

6.3

Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Use, and may result in our taking all or any of the following actions (with or without notice):
(a) issuing of a warning to you;
(b) immediate, temporary or permanent withdrawal of your right to use the Site;
(c) legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and/or
(d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

7. Our responsibility

In every case, we will never be responsible for any loss or damage that:
(a) is not reasonably foreseeable, meaning it was not obvious that it would happen and nothing you said to us when you accessed the Site meant we should have expected it; or

We do not in any way exclude or limit our liability where it would be unlawful for us to do so, including for:
(a) intentional or grossly negligent breaches of our obligations;
(b) damages arising from death or personal injury caused intentionally or by our negligence; and
(c) fraud or fraudulent misrepresentation, including the fraudulent concealment of defects.

8. Security

8.1

We care about the integrity and security of your personal information. However, we cannot guarantee that unauthorised third parties will never be able to defeat our security measures or use your personal information for improper purposes.

Where our Site contains links to other Sites and resources provided by third parties, these links are provided for your information only. 9. Our site changes regularly

11. Other important terms

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms of Use, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

12. Applicable law and jurisdiction

12.1

These Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by and shall be construed in accordance with English law. We both irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms of Use or their subject matter or formation.
